Membership Agreement

1. Parties

a) Conducting the activities of the website and headquartered at Levent Mah. Sedir Sok. No:6 Beşiktaş/ISTANBUL, ARKEVİTAL KOZMETİK SANAYİ VE TİCARET LTD ŞTİ. , (hereinafter referred to as "Beauté Attendue").

b) Internet user who is a member of the website ("Member").

 

2. Subject of the Agreement

The subject of this Agreement is to determine the conditions under which the member can benefit from the website owned by Beauté Attendue.

 

3. Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information provided when becoming a member of the website is accurate under the law, and will fully and immediately compensate Beauté Attendue for any damages due to the inaccuracy of this information.

3.2. The Member cannot give the password provided by Beauté Attendue to other individuals or organizations; the right to use the password belongs solely to the member. Therefore, Beauté Attendue reserves the right to compensation for any damages and other claims that third parties or competent authorities may assert against Beauté Attendue due to unauthorized use of such password.

3.3. The Member agrees to comply with the legal provisions while using the website and not to violate them. Otherwise, all legal and criminal liabilities arising will be entirely and exclusively binding on the member.

3.4. The Member cannot use the website in a way that disrupts public order, is contrary to general morality, disturbs or harasses others for an illegal purpose, or infringes on the intellectual and copyright of others. Additionally, the member cannot engage in activities that prevent or make it difficult for others to use the services (spam, viruses, trojan horses, etc.).

3.5. Ideas and thoughts expressed by members on the website are solely the personal opinions of the members and bind the owner of the opinion. These opinions and thoughts have no connection to Beauté Attendue. Beauté Attendue has no responsibility for any damages that third parties may incur due to the views and thoughts declared by the member and any damages that the member may incur due to the opinions and thoughts stated by third parties.

3.6. Beauté Attendue is not responsible for unauthorized access to member data and any damages to member software and data. The member expressly agrees not to claim compensation from Beauté Attendue for any damages that may arise from using the website.

3.7. The member agrees not to access or use the software and data of other internet users without permission. Otherwise, any legal and criminal liabilities arising from this will be entirely the member's responsibility.

3.8. A member who violates one or more of the articles listed in this membership agreement will be personally and legally responsible for this violation, and Beauté Attendue will be exempt from the legal and criminal consequences of these violations. In addition, if the violation is brought into the legal field, Beauté Attendue reserves the right to claim compensation from the member for non-compliance with the membership agreement.

3.9. Beauté Attendue has the right to unilaterally delete the member's membership when necessary and delete the customer's files, documents, and information. The member accepts this provision in advance. In this case, Beauté Attendue has no responsibility.

3.10. The software and design of the website are owned by Beauté Attendue and are protected by copyright and/or other intellectual property rights under the relevant laws. They cannot be used, acquired, or modified without the member's permission. Other companies and products mentioned on this website are trademarks of their respective owners and are protected under intellectual property rights.

3.11. For the improvement of the website by Beauté Attendue, or within the framework of legal regulations, various information may be collected, such as the name of the Internet service provider used to access the site, Internet Protocol (IP) address, date and time of access to the site, pages accessed during the visit, and the Internet address of the website that directly connects to the site.

3.12. To provide better service to Beauté Attendue users, improve its products and services, and facilitate the use of the site, Beauté Attendue may use the personal information of members in studies related to the individual preferences and interests of users. Beauté Attendue reserves the right to keep a record of the member's actions on the website.

3.13. The person who becomes a member of Beauté Attendue declares and accepts that, within the scope of the current and/or future applications, all websites owned by Beauté Attendue and its subsidiary Arkevital Cosmetics may offer product and service promotions, advertisements, campaigns, advantages, surveys, and other customer satisfaction practices. The member also declares and accepts that, when becoming a member of Beauté Attendue and/or in different ways in the past and/or in the future, the personal and shopping information and shopping and/or consumer behavior information provided will be collected for the above purposes, shared with all websites owned by Arkevital Cosmetics, used, and archived by Beauté Attendue and all websites owned by Arkevital Cosmetics. Unless otherwise stated, the member declares and accepts that, even when their membership ends, they allow the collection of data, sharing with all websites owned by Arkevital Cosmetics, use, and archiving by Beauté Attendue and all websites owned by Arkevital Cosmetics. Unless otherwise stated, the member declares and accepts that Beauté Attendue and all websites owned by Arkevital Cosmetics can contact them through the Internet, telephone, SMS, etc. communication channels. The member declares and accepts that they will not claim directly and/or indirectly any material and/or moral damage, whether negative and/or positive, in any way due to the collection, sharing, use, archiving, and access to the mentioned information, and will not hold Beauté Attendue and websites owned by Arkevital Cosmetics responsible. If the member wishes to change data sharing preferences, he/she can convey this request to the customer service call centers of Beauté Attendue.

3.14. Beauté Attendue may disclose the personal information of the member when requested as a legal obligation or when it believes in good faith that it is necessary to (a) act per legal requirements or comply with legal proceedings notified to Beauté Attendue; (b) protect and defend the rights and property of Beauté Attendue and the Beauté Attendue website family.

3.15. Efforts have been made to protect the website from viruses and similar malicious software within the available facilities. In addition, for ultimate security, the user must provide their virus protection system and ensure the necessary protection. In this context, the member is considered to have accepted that they are responsible for all errors that may occur in theirsoftware and operating systems and their direct or indirect consequences by entering the Beauté Attendue website.

3.16. Beauté Attendue reserves the right to change the site's content at any time, modify or terminate any service provided to users, or delete user information and data registered on the Beauté Attendue website.

3.17. Beauté Attendue may change, update, or cancel the conditions of the membership agreement at any time without the need for prior notice and/or warning. As of the publication date, any amended, updated, or repealed provisions will be adequate for all members.

3.18. The parties accept and declare that all computer records belonging to Beauté Attendue will be taken as the sole and genuine evidence per Article 287 of the Turkish Code of Civil Procedure (HUMK) and that these records constitute an evidence agreement.

3.19. Beauté Attendue has the authority to send informative emails to the email addresses registered with its members and informative SMS messages to their mobile phones under this membership agreement. Upon confirming this membership agreement, the member will be deemed to have accepted the sending of informative emails to the email address and informative SMS messages to the mobile phone. If the member wishes to unsubscribe from receiving emails and/or SMS, they can perform the cancellation process through the "My Page" section under the "Preferences" section.

 

4. Termination of the Agreement

This Agreement will remain in effect until the member cancels their membership or until Beauté Attendue cancels their membership. In the event of any violation of the terms of the membership agreement by the member, Beauté Attendue may unilaterally terminate the Agreement by canceling the member's membership.

 

5. Resolution of Disputes

In case of disputes arising from this Agreement, Istanbul Courts and Execution Offices are authorized.

 

6. Effectiveness

The member registering for membership implies that the member has read all the articles in the membership agreement and accepted the articles in the membership agreement. This Agreement is concluded and mutually effective as of the moment the member becomes a member.
